1. SELLER INFORMATION

This contract is prepared in accordance with the obligation to establish a contract for sales conducted over the internet, as stipulated in the Regulation on the Procedures and Principles of Distance Contracts published in the Official Gazette dated 13.06.2003 and numbered 25137, and is set forth in the following articles.

2. SUBJECT

The subject of this agreement is the sale and delivery of the product, which is being sold by the SELLER to the BUYER, with its characteristics and sale price specified below. This is in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures of Distance Contracts, which outline the rights and obligations of the parties involved.

2.1 RECIPIENT INFORMATION

A person who is a member of the shopping site www.safbox.com.tr as a customer. The address and contact information used during membership registration are taken as the basis.

3. PRODUCT INFORMATION SUBJECT TO THE CONTRACT

The type, quantity, brand/model, color, number, sale price, payment method, and information available at the time the order is completed.

4. GENERAL PROVISIONS

4.1 The BUYER declares that they have read and understood all preliminary information regarding the essential qualities of the product or products related to the contract specified in Article 3, including the sale price, payment method, and delivery details, and that they have given the necessary confirmation in electronic form.

4.2 The products covered by the contract will be delivered to the Buyer or the person/entity indicated at the address, within the timeframe specified in the preliminary information, depending on the distance from the Buyer's residence, without exceeding the legal 30-day period. This period may be extended by a maximum of 10 days, provided the Buyer is informed in advance.

4.3 If the product subject to the contract is to be delivered to a person or entity other than the BUYER, MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ cannot be held responsible for the non-acceptance of the delivery by the designated person or entity.

4.4 MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ is responsible for delivering the contracted products in a sound and complete condition, in compliance with the specifications mentioned in the order, along with any warranty documents and user manuals, if applicable.

4.5 The delivery of the product subject to this contract is conditional upon the signed copy of this agreement being received by MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ and the payment being made in the form preferred by the Buyer. If for any reason the payment for the product is not made or is canceled in the bank records, MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ will be considered relieved of its obligation to deliver the product.

4.6 If, after the delivery of the product, the BUYER's credit card is used by unauthorized persons in an unjust or unlawful manner not attributable to the BUYER, and as a result, the relevant bank or financial institution does not make the payment for the product to MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ, the BUYER is required to return the product to MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ within 3 days, provided that it has been delivered to them. In this case, the transportation costs will be borne by the BUYER.

4.7 If MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ is unable to deliver the product specified in the contract within the stipulated time due to extraordinary circumstances such as force majeure or adverse weather conditions affecting transportation, it is obligated to inform the BUYER of the situation. In this case, the BUYER has the right to request the cancellation of the order, to replace the product with a comparable item, and/or to postpone the delivery until the obstructive situation is resolved. If the BUYER decides to cancel the order, the amount paid will be refunded in cash and in full within 15 business days.

4.8 Products sold with a warranty certificate, whether they are under warranty or not, that are defective or malfunctioning may be sent to MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ for necessary repairs within the warranty conditions; in this case, shipping costs will be covered by MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ.

4.9 In purchases made by non-consumer BUYERS for one or more products, even if the order has been placed and the amount has been charged to the BUYER's credit card (or other payment methods), the SELLER has the right to cancel the contract (order) or part of the order without stating any reason prior to delivery. The amount paid may be refunded to the BUYER's credit card (or account) in the same manner it was paid. The transfer of the refunded amount to the BUYER's account is the responsibility of the institution that issued the card or holds the account, and the SELLER is not liable for any delays that may occur.

4.10 This agreement will become valid after being signed by the BUYER and delivered to MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ via fax or mail, or after the relevant contract approval box is checked on www.safbox.com.tr and the order is completed.

5. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within seven (7) days from the delivery of the product to themselves or to the person/institution they have designated. To exercise the right of withdrawal, the BUYER must notify Safbox via fax, email, or phone within this period, and the product must not have been used in accordance with the relevant provisions. In case of exercising this right, it is mandatory to send the product delivered to the third party or the BUYER back to Safbox along with a copy of the cargo delivery receipt and the original invoice. The product price will be refunded to the BUYER within 15 days of receiving these documents. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded. The shipping cost of the product returned due to the right of withdrawal will be borne by the BUYER. If the order needs to be canceled, it can be done by calling the customer representative at (0532) 785 20 85 until 15:00 on the day the order was confirmed. The right of withdrawal cannot be exercised for products that are non-returnable by nature, single-use products, quickly perishable items, or products that have passed their expiration date. Additionally, for goods produced based on the consumer's special requests and requirements or customized products made through modifications or additions, the consumer cannot exercise the right of withdrawal. If payment is made by credit card or a similar payment card, the consumer may request the cancellation of the payment transaction on the grounds that the card was used unlawfully and without their consent. In this case, the issuing institution must refund the amount to the consumer within 15 business days from the notification of the objection. In the implementation of this contract, Consumer Arbitration Committees and the Consumer Courts located in the settlement of MERDEM TARIM GIDA SANAYİ VE TİCARET ANONİM ŞİRKETİ are authorized up to the amount announced by the Ministry of Industry and Trade. In case the order is completed, the BUYER will be deemed to have accepted all the terms of this contract.​
